Welcome to the the Sentinel website, owned and operated by Centralia Press, Ltd., a Delaware corporation. These Terms of Use apply to the the Sentinel's website located at morningsentinel.com (the Site). This Site is the property of the Sentinel and its licensors, if any.


1.1 These Terms of Use govern your use of the Site, including any features or content appearing on the Site. Your use of the Site constitutes your acceptance and agreement to these Terms of Use. If you do not agree to these Terms of Use, do not use the Site.

1.2 The Sentinel may change, add or remove portions of these Terms of Use at any time, which shall become effective immediately upon posting. The date of the most recent version of these Terms of Use is posted above (the “Modification Date”) and it is your responsibility to periodically review these Terms of Use to check for an updated or modified version. USING THE SITE AFTER THE MODIFICATION DATE WILL CONSTITUTE YOUR AGREEMENT TO THE MODIFIED VERSION OF THESE TERMS OF USE. IF THESE TERMS OF USE (INCLUDING MODIFICATIONS, IF ANY) ARE UNACCEPTABLE TO YOU, YOU MAY CANCEL YOUR USER ACCOUNT BY SENDING AN E-MAIL TO: rsmith@morningsentinel.com (SEE SECTION 10.1 REGARDING TERMINATION).

1.3 The Sentinel may change, suspend or discontinue any aspect of the Site at any time, including the availability of any Site feature, database, or content. The Sentinel may also impose limits on certain features and services or restrict your access to parts or all of the Site without prior notice or liability to you. From time to time there may be information on the Site that is outdated or contains errors, inaccuracies or omissions. We reserve the right to correct any such errors, inaccuracies or omissions.


2.1 The content of the Site is intended for your personal, noncommercial use. All materials published on the Site (including, but not limited to news articles, photographs, images, illustrations, audio clips and video clips, also known as the "Content(s)" are protected by copyright pursuant to U.S. and international copyright laws, and are owned or controlled by The Sentinel or the party credited as the provider of the Content. You agree to abide by all additional copyright notices, information, or restrictions contained in any Content accessed through the Site. You may not modify, publish, transmit, participate in the transfer or sale of, reproduce (except as provided in Section 2.2 of these Terms of Use), create derivative works from, distribute, perform, display, or in any way exploit, any Content on the Site (including software, if any) in whole or in part.

2.2 You may download or copy the Content and other downloadable items displayed on the Site for your personal use only, provided that you are required to maintain all copyright and other notices contained therein. Copying or storing of any Content for other than personal use is expressly prohibited without prior written permission from the Sentinel, or the copyright holder identified in the copyright notice contained in the Content.

2.3 The Content featured on the Site is owned or licensed to the Sentinel. Certain Content is furnished by the Associated Press, UPI (United Press International) and other providers, which will not be liable for any delays, inaccuracies, errors or omissions in any such Content, or in the transmission or delivery of all or any part thereof, or for any damages arising therefrom.


3.1 (a) No illegal content. You shall not upload to, or distribute or otherwise publish onto the Site any libelous, defamatory, obscene, pornographic, abusive, infringing or otherwise illegal material.

3.1 (b) Be courteous. You agree that you will not threaten or verbally abuse other Site users (“Users”), use defamatory language, or deliberately disrupt discussions with repetitive messages, meaningless messages or "spam."

3.1 (c) Use respectful language. Like any community, the online conversation flourishes only when our Users feel welcome and safe. You agree not to use language that abuses or discriminates on the basis of race, religion, nationality, gender, sexual preference, age, region, disability, etc. Hate speech of any kind is grounds for immediate and permanent suspension of access to all or part of the Site.

3.1 (d) Debate, but don't attack. In a community full of opinions and preferences, people always disagree. The Sentinel encourages active discussions and welcomes heated debate on the Site. But personal attacks are a direct violation of these Terms of Use and are grounds for immediate and permanent suspension of access to all or part of the Site.

3.2 The Site shall be used only in a noncommercial manner. You shall not, without the express approval of Centralia, distribute or otherwise publish any material containing any solicitation of funds, advertising or solicitation for goods or services.

3.3 You acknowledge that any submissions you make to the Site (i.e., user-generated content including but not limited to: comments, forum messages, reviews, text, video, audio and photographs, as well as computer code and applications) (each, a "Submission") may be edited, removed, modified, published, transmitted, and displayed by the Sentinel and you waive any rights you may have in having the material altered or changed in a manner not agreeable to you. Submissions made to the Site may also be included in our RSS feeds, APIs and made available for republishing through other formats.

3.4 You grant the Sentinel a perpetual, transferable, nonexclusive, worldwide, royalty free, sub-licensable license to the Submissions, which includes without limitation the right for the Sentinel or any third party designated by the Sentinel, to use, copy, transmit, excerpt, publish, distribute, publicly display, publicly perform, create derivative works of, host, index, cache, tag, encode, modify and adapt (including without limitation the right to adapt to streaming, downloading, broadcast, mobile, digital, thumbnail, scanning or other technologies) in any form or media now known or hereinafter developed, any Submission posted by you on or to the Sentinel or any other website owned by the Sentinel, including any Submission posted on the Site through a third party.

3.5 You are solely responsible for the content of your Submissions. However, while the Sentinel does not and cannot review every Submission and is not responsible for the content of these messages. The Sentinel reserves the right to delete, move, or edit Submissions that it, in its sole discretion, deems abusive, defamatory, obscene, in violation of copyright or trademark laws, in violation of these Terms of Use, or otherwise unacceptable to the Sentinel.

3.6 By making a Submission, you are consenting to its display on the Site and for related online and offline promotional uses.


The Site may contain links to other third party Internet websites, resources, and sponsors of the Sentinel (“Third Party Website(s)”). You acknowledge and agree that these Third Party Websites are not owned or controlled by the Sentinel and that in providing links to such Third Party Websites, the Sentinel is not affiliated with, nor is the Sentinel endorsing, the Third Party Websites or any products or services associated with the Third Party Websites. The Third Party Website may be subject to terms of use and/or privacy policies that differ from these Terms of Use or the Sentinel’s Privacy Policy. You should review the terms of use and/or privacy policy of each Third Party Website you visit prior to using the Third Party Website. Further, since the Sentinel is not responsible for the availability of the Third Party Websites or their content, you should direct any concerns regarding any Third Party Websites to the site administrator or webmaster of such Third Party Website.


5.1 You represent, warrant and covenant (a) that no materials of any kind submitted through your account will (i) violate, plagiarize, or infringe upon the rights of any third party, including copyright, trademark, privacy rights or other personal or proprietary rights; or (ii) contain libelous or otherwise unlawful material; and (b) that you are at least thirteen years old. You hereby agree to indemnify, defend and hold harmless the Sentinel, and all officers, directors, owners, employees, agents, information providers, affiliates, licensors and licensees of the Sentinel (collectively, the "Indemnified Parties"), for, from and against any and all liabilities, expenses, damages and costs of any kind or nature, including without limitation, reasonable attorneys' fees and legal costs, incurred by the Indemnified Parties in connection with any claim(s) arising out of any breach by you or any user of your User account of these Terms of Use, including the foregoing representations, warranties and covenants. You shall cooperate as fully as reasonably required in the defense of any such claim. the Sentinel reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you.

5.2 The Sentinel does not represent or endorse the accuracy or reliability of any advice, opinion, statement, or other information displayed, uploaded, or distributed through the Site by any user, information provider or any other person or entity. You acknowledge that any reliance upon any such opinion, advice, statement, memorandum, or information shall be at your sole risk. THE SITE AND ALL DOWNLOADABLE SOFTWARE, IF ANY, ARE DISTRIBUTED ON AN "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. ALL SUCH WARRANTIES ARE EXPRESSLY DISCLAIMED. YOU HEREBY ACKNOWLEDGE THAT USE OF THE SITE IS AT YOUR SOLE RISK.


6.1 In order to use certain parts of the Site, you may be required to register with The Sentinel and select a password and a User ID. the Sentinel also requires that you provide certain registration information, all of which must be accurate and updated. You agree that: (a) you may not (i) select or use a User ID of another person with the intent to impersonate that person; (ii) use a User ID in which another person has rights without such person's authorization; or (iii) use a User ID that the Sentinel, in its sole discretion, deems offensive. Failure to comply with the foregoing shall constitute a breach of these Terms of Use, which may result in immediate termination of your account; and (b) you shall be solely responsible for maintaining the confidentiality security of your User ID and password.

6.2 You agree to notify the Sentinel at rsmith@morningsentinel.com of any known or suspected unauthorized use(s) of your account, or any known or suspected breach of security, including loss, theft, or unauthorized disclosure of your password or credit card information.

6.3 You must be 13 years or older to subscribe to all parts of the Site.

6.4 You are responsible for all usage or activity on your Sentinel account, including use of the account by any third party authorized by you to use your User ID and password. Any fraudulent, abusive, or otherwise illegal activity may be grounds for termination of your account, at the Sentinel's sole discretion, and the Sentinel may refer you to appropriate law enforcement agencies.


The Sentinel reserves the right at any time to charge fees for access to portions of the Site or the Site as a whole. However, in no event will you be charged for access to the Site unless we obtain your prior agreement to pay such charges. Thus, if at any time the Sentinel requires a fee for portions of the Site that are now free (e.g., a domestic subscription fee), the Sentinel will give you advance notice of such fees and the opportunity to cancel your account before such charges are imposed. You shall pay all fees and charges incurred through your account at the rates in effect for the billing period in which such fees and charges are incurred, including, but not limited to charges for any products or services offered for sale through the Site by the Sentinel or by any other vendor or service provider. All fees and charges shall be billed to and paid for by you. You shall pay all applicable taxes relating to use of the Site through your account.


8.1 If you indicate on your registration form that you want to receive such information, the Sentinel, its owners and assigns, will allow certain third party vendors to provide you with information about products and services.

8.2 The Sentinel may give you notice by any lawful method, including without limitation, legal notices and notices of subpoenas, and we reserve the right to send electronic mail to you for the purpose of informing you of changes or additions to the Site. You acknowledge and agree that any transaction(s) between you and the Sentinel pursuant to these Terms of Use may be conducted electronically.

8.3 The Sentinel reserves the right to disclose information about your usage and demographics, provided that it will not reveal your personal identity in connection with the disclosure of such information. We may also use and/or disclose your information in other ways, as set forth in our Privacy Policy. For more information on how we collect and use your information, please carefully read our Privacy Policy .

8.4 The Sentinel may contact you via e-mail regarding your participation in user surveys, asking for feedback on the Site and existing or prospective products and services. This information will be used to improve the Site and to better help us understand our Users, and any information we obtain in such surveys will not be shared with third parties, except in aggregate form.

8.3 You agree to send us notices pursuant to our contact information set forth in Section 11.2 below.


You shall have no rights to the proprietary software and related documentation, or any enhancements or modifications thereto, if any, provided to you in order to access the Site ("Access Software"). You may not sublicense, assign or transfer any licenses granted by the Sentinel, and any attempt at such sublicense, assignment or transfer shall be null and void. Further, you may not copy, distribute, modify, reverse engineer, or create derivative works from Access Software.


10.1 You may terminate your User account at any time by sending an e-mail to: support@morningsentinel.com. Upon termination, you will receive a confirmation via e-mail that the request was received, and your access will be suspended within twenty-four (24) hours. You are responsible for any and all charges incurred (for products or services purchased) up to the time the account is deactivated.

10.2 The Sentinel may, in its sole discretion, terminate or suspend your access to all or part of the Site for any reason, including, without limitation, breach or assignment of these Terms of Use.


11.1 Choice of Law. These Terms of Use have been made under and shall be construed and enforced in accordance with laws of the State of Illinois, without regard to its conflict of laws principles. Any action to enforce these Terms of Use shall be brought in federal or state courts located in the State of Illinois, and by using the Site, you consent to the personal jurisdiction of such courts over you and waive any claim that such a forum is an inconvenient forum.

11.3 Notice of Copyright Infringement. The Sentinel respects the intellectual property rights of third parties and requests that you do the same. Anyone who believes that his or her work has been reproduced in the Site in a way constituting copyright infringement may provide a notice to our designated Copyright Agent for the Site containing the following:

(a) an electronic or physical signature of a person authorized to act on behalf of the owner of the copyright interest;

(b) identification of the copyrighted work claimed to have been infringed; (c) identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material; (d) the address, telephone number, and, if available, an e-mail address at which the complaining party may be contacted; (e) a representation that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and (f) a representation that the information in the notice is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

11.4 Statute of Limitations. You agree to file any claim regarding any aspect of this site or these Terms of Use within six (6) months of the time in which the events giving rise to such claim began, or you agree to waive such claim.

11.5 No Class Actions. You agree no claim subject to these Terms of Use may be brought as a class action.

11.6 Severability. If for any reason any provision of this Agreement is found unenforceable, that provision shall be enforced to the maximum extent permissible so as to effect the intent of the parties as reflected in that provision, and the remainder of the Agreement shall continue in full force and effect.

11.7 No Waiver. Any failure of the Sentinel to enforce or exercise any provision of this Agreement or related right shall not constitute a waiver of that right or provision.

11.8 Section Titles. The section titles used in this Agreement are purely for convenience and carry with them no legal or contractual effect.

11.9 Survival. In the event of termination of this Agreement for any reason, you agree the following provisions will survive: the provisions regarding limitations on your use of Content, the license(s) you have granted to the Sentinel, and all other provisions for which survival is equitable or appropriate.

11.10 Conflicts. In the case of a conflict between these terms and the terms of any electronic or machine readable statement or policy (for example, a P3P electronic privacy policy), these Terms of Use shall control. Similarly, in case of a conflict between these terms and our Privacy Policy, these Terms of Use control.
